Motoring Offences Solicitors

If you face a court hearing, either after being charged by the police or receiving a postal requisition then you will need to take advice from an experienced advocate who specialises in Criminal Law.

The Criminal department here at Wace Morgan Solicitors is led by Paul Nicholas, who has been specialising in criminal law for over twenty years, representing clients through the justice system covering all types of offences.

Paul has specific experience in Motoring Law having represented clients who have been charged with causing death by dangerous driving through to speeding.

A primary concern for anybody facing a conviction for a motoring offence will be the penalty points that must be added to their driving licence, or the fear of a period of disqualification from driving either because of the offence itself or as a “totter” (the accumulation of twelve penalty points for any motoring offence accrued in any three year period).

Paul can advise on the procedure, possible outcome and any possible application that the law allows for you to keep your driving licence and not be disqualified from driving for any period.

Even if you are currently servicing a driving disqualification Paul can advise on the procedure for your driving licence to be reinstated by way of application to the court, should the relevant legal criteria be satisfied.

Unfortunately, most motoring offences do not meet the legal aid criteria for it to be considered in the public interest to grant public funding for such offences. Further, most people who are facing a court hearing for motoring offences may not qualify for legal aid on the “means criteria” due to their level of income. It is primarily for this reason that we do not have a legal aid contract and therefore all advice will be on a private paying basis which will allow specific and tailored advice to be given to you irrespective of the nature of the allegation and/or application that can be made on your behalf.

Please call Paul to discuss any criminal matters and to obtain a quote to get the best possible advice and representation.

The main offences that Paul advises on are:

  • Retaining driving licence should you reach 12 penalty points in any 3 year period
  • Reinstatement of driving licence
  • Dangerous or careless driving
  • Drink or drunk driving
  • Using a mobile phone whilst driving
  • Speeding offences
  • No insurance
  • Failing to stop and report an accident
  • Failing to provide information of a 172 notice
